This Privacy Policy covers my treatment of information that I gather when you are accessing or using my Website or Services or when you contact me in any manner. What information does DJ Tony Schwartz Collect?

When you use my Website I may collect any Personal Information that you choose to send to me or provide to me. For example, on my “Contact” online form or if you register for the Tony Schwartz VIP List. If you contact me through my Website, I will keep a record of our correspondence.

When you use the Services: I receive and store information you provide directly to me. The types of information I may collect directly from my customers include but are not limited to: name, email address, postal address, phone number, transactional information (including Services purchased), as well as any other contact or other information they choose to provide me or upload to my systems in connection with the Services.

When you use the Website: When you visit the Website, I collect certain information related to your device, such as your device’s IP address, referring website, what pages your device visited, and the time that your device visited my Website.

When you use the Services:

Usage information: I keep track of user activity in relation to the types of Services my customers and their users use and performance metrics related to their use of the Services.

Log information: I log information about my customers and their users when you use one of the Services including Internet Protocol (“IP”) address.

Information collected by cookies and other similar technologies: I use various technologies to collect information which may include saving cookies to users’ computers.

How do I use the information?

Website: I will use the information I collect via my Website:

• To administer my Website and for internal operations, including troubleshooting, data analysis, testing, statistical and survey purposes;
• To improve my Website to ensure that content is presented in the most effective manner for you and for your computer;
• To analyze customers’ use of my Website for trend monitoring, marketing and advertising purposes;
• For purposes made clear to you at the time you submit your information. For example, to provide you with information you have requested about my Services
• As part of my efforts to keep my Website safe and secure.

How do I share and disclose information to third parties?

I do not rent or sell your Personal Information to anyone. I may share and disclose information (including Personal Information) about my customers in the following limited circumstances:

Vendors, consultants and other service providers: I may share your information with third party vendors, consultants and other service providers who I employ to perform tasks on my behalf.

If DJ Tony Schwartz has received your Personal Information in the United States and subsequently transfers that information to a third party agent or service provider for processing, DJ Tony Schwartz shall remain responsible for ensuring that such third party agent or service provider processes your Personal Information to the standard required by law (see the section below headed “International Data Transfers”). Unless I tell you otherwise and you consent, my vendors do not have any right to use the Personal Information I share with them beyond what is necessary to assist me.

Right to Deletion of Personal Information – California Consumers

California residents have the right to request the deletion of Personal Information as prescribed in Section 1798.105(a) of the CCPA. DJ Tony Schwartz may not delete some or all Personal Information if such Personal Information is necessary for me, or my service providers or affiliates, to:

• Complete the transaction for which the Personal Information was collected, provide a good or service requested by the consumer, or reasonably anticipated within the context of DJ Tony Schwartz’s ongoing business relationship with the consumer, or otherwise perform a contract between DJ Tony Schwartz and the consumer,
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity,
• Debug to identify and repair errors that impair existing intended functionality,
• Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law,
• Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code,
• Enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with DJ Tony Schwartz,
• Comply with a legal obligation, or
• Otherwise use the consumer’s Personal Information, internally, in a lawful manner that is compatible with the context in which the consumer provided the Personal Information.

You may also request to receive:

Right to not be Discriminated Against for Exercising your Rights – California Consumers

I do not discriminate against you for exercising any of your CCPA rights, such as your access and deletion rights described above. However, I may offer you rewards (such as through my loyalty program) or benefits (such as customizing your experience at a resort) which I need your data to provide, but I will only provide those rewards or benefits if their value to you is reasonably related to the value provided to DJ Tony Schwartz by your Personal Information.

I collect identifiers that you may choose to provide to me, such as your name, email address, mailing address, phone number, birthday, and age. I use this information to communicate with you, market goods and services, and to provide you with goods and services.

I collect and use identifiers (such as a username) you may choose to provide to me, and the content of your communications when you post information on my online message boards or online public forums. I use this information to run my online message boards or online public forums.

DJ Tony Schwartz discloses identifiers (e.g., name or email address), internet activity, consumer history, and consumers’ preferences to provide marketing and analytics services to its business partners.

DJ Tony Schwartz discloses identifiers, consumer history, and consumers’ preferences to my franchisees and licensees to offer my Services.

DJ Tony Schwartz may share your personal information with third party service providers that perform a variety of services on my behalf, such as the development and analysis of my social media pages, operating and maintaining my websites, offering or managing promotions, and market research purposes.

DJ Tony Schwartz may share your personal information with other entities for purposes of a sale, merger, or other related corporate event. An entity that buys me or a part of my business may continue to use your personal information in accordance with this Privacy Notice.

Removing Content on Public Forums – California Consumers

If you are a California resident between the age of 13 and 18 and are a registered user on the Service and participate in the online public forums offered through the Service, you may request that I remove content or information about you that you posted by (a) submitting a request in writing to Hello@DJTonySchwartz.com with the subject: “Deletion Request”, and (b) clearly identifying the content or information you wish to have removed and providing sufficient information to allow me to locate the content or information to be removed. However, please note that I am not required to erase or otherwise eliminate content or information if (i) other state or federal laws require me or a third party to maintain the content or information; (ii) the content or information was posted, stored, or republished by another user; (iii) the content or information is anonymized so that you cannot be individually identified; (iv) you do not follow the instructions posted in this Privacy Notice on how to request removal of your content or information; or (v) you have received compensation or other consideration for providing the content. Further, nothing in this provision shall be construed to limit the authority of a law enforcement agency to obtain the applicable content or information.

Is Personal Information about You secure?

I use technical, organizational and administrative security measures to protect all information I hold in my records from loss, misuse, and unauthorized access, disclosure, alteration and destruction.  Unfortunately, no company or service can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information. Among other practices, your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

International Data Transfers

Personal Information you submit on the Website or through the Services is sent to the United States and will be primarily processed by me in the United States and potentially in other countries, on my servers or on my hosted service providers cloud servers on my behalf. I do not knowingly collect or solicit personal information from anyone under the age of 16.
